1. Agreement
By accessing or using Observinio at observinio.com (the “Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
2. What Observinio does
Observinio publishes automated measurements of third-party AI provider APIs — including latency, availability, and regional variance — from multiple geographic regions. We also offer optional email alerts, status history, and informational content such as blog posts and resources.
Observinio does not operate, control, or guarantee the performance of any third-party AI provider. Measurements reflect probe results at specific times and locations; they may not match your own experience or production traffic patterns.
3. No professional advice
All data, charts, status indicators, and alerts on Observinio are provided for general information only. They do not constitute technical, legal, financial, operational, or procurement advice. You are solely responsible for decisions you make based on information from the Service.
4. Acceptable use
You agree not to:
- Abuse, overload, or attempt to disrupt the Service or its infrastructure
- Use the Service for unlawful purposes or in violation of applicable regulations
- Subscribe email addresses without the account holder’s consent
- Scrape, mirror, or republish substantial portions of the Service without permission
- Attempt to circumvent rate limits, authentication, or security measures
We may suspend or restrict access if we reasonably believe your use violates these Terms or poses a risk to the Service or other users.
5. Email alerts and subscriptions
Email alerts require double opt-in: after subscribing, you must confirm your address within 48 hours before alerts become active. You may unsubscribe at any time via links in our emails or through your subscription manage page.
Alert delivery depends on third-party email providers and your mail configuration. We do not guarantee that every alert will be delivered promptly or at all.
6. Accounts and data
Observinio v1 does not require a password-based account. Subscription management uses secure, token-based links sent to your email. You are responsible for keeping those links private.
7. Intellectual property
The Observinio name, branding, website design, charts, and original written content are owned by the operator or its licensors. You may link to public pages and share excerpts for non-commercial reference with attribution, but may not copy or redistribute substantial content without permission.
8. Third-party services
AI providers, hosting, email, and analytics services used by Observinio are governed by their own terms and privacy policies. Your use of those providers’ APIs is separate from your use of Observinio.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT MEASUREMENTS WILL BE ACCURATE, COMPLETE, TIMELY, OR ERROR-FREE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED USD $100.
11. Changes
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use after changes constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of Poland, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of courts in Poland, unless mandatory consumer protection law in your country requires otherwise.
